Ancillary Relief
The process of the division of matrimonial assets is known as Ancillary relief. It is distinct from divorce proceedings and contact/custody of children proceedings.
The procedure is governed by the Family Procedure Rules, which sets out the criteria to be followed. The concept of the new rules is to simplify and speed up the procedure for applying for Financial Court orders.
During ancillary relief proceedings rules require three stages to resolve the matrimonial assets. These are:

It is important to note that not all division of matrimonial assets must result in Court Proceedings.
The parties can reach amicable settlement and agree the distribution of their matrimonial assets. This can be dealt with by way of a Consent Order. The Consent Order can that be stamped by the Court. There are however various procedure to follow.
