The Custody and Contact of Children
We know that children need both parents in their lives. The courts are required to look at the welfare of the children. Their best interest is paramount hence it is important to always think and consider that the welfare of the children first as the court will tolerate no compromises. It is unacceptable for one party to allow the reasons for the divorce to prevent a parent from having access (contact) or custody of his/her child.
At SJS Solicitors we can advise and act for you in respect of the following:
Custody and contact issues - contact not only refers to visiting rights and staying, but it also covers other forms of communication, such as letters or telephone contact.
Residence - settles the issue of with whom the child lives.
Parental Responsibility - applications to court, giving father’s who do not have parental responsibility, their rights. Then both parents will have a say in their child(ren) welfare/education/health and upbringing.
Prohibited Steps Orders - prohibits the person specified in the order from taking a certain step example preventing a parent removing a child from the court's jurisdiction.
Specific Issue Orders - which cover, for example, what school they should go or disputes over change of name.
