There are certain criteria which you must fulfil to be successful in this category. The meaning of private life comes from Article 8 of the European Convention on Human Rights (ECHR).

It is the right to respect for one’s private and family life his home and his correspondence. The private life category comes under the Home Office’s immigration rule r276 ADE(1) and allows an applicant to regularise their stay in the UK by way of an application on the grounds of private life, under long residence where part of their residence may or may not have been lawful.

As a guideline, generally to be successful in an application under by satisfying rule 276 ADE (1) requires the applicant to satisfy the following:

• has lived continuously in the UK for at least 20 years (discounting any period of imprisonment) or...
• is under the age of 18 years and has lived continuously in the UK for at least 7 years (discounting any period of imprisonment) and it would not be reasonable to expect the applicant to leave the UK or...
• Is aged 18 years or above and under 25 years and has spent at least half of his life living continuously in the UK (discounting any period of imprisonment) or...
• The applicant must be aged 18 years or above, has lived continuously in the UK for less than 20 years (discounting any period of imprisonment) and there would be very significant obstacles to the applicant’s integration into the country to which he would have to go if he was removed from the UK

In addition, there is the suitability requirements under Appendix FM at section S-SLTR to be satisfied. Such requirements must be fulfilled in order to enable your application to succeed. Fees

Our Fees for this type of visa are fixed at £1875 + VAT, this includes our consultancy fee of £125 + VAT, which includes a 45 minute meeting with our Principal Solicitor where we discuss the details of your case, and allow you to decide if you would like to proceed with instructing our firm, if you decide not to, only the consultancy fee is payable. Our fees do not include any Home Office fees or disbursements which have to be paid separately.

Our consultancy fee includes:

• A 45 minute meeting with our Principal Solicitor
• A client care letter detailing all advice given in the meeting sent within 24 hours
• The option to choose if you want to instruct our firm or not for your matter
