We can help you to apply for a Spouse, Partner and Family Member Visas, which, if successful would allow you to come to the UK for a maximum of 33 months if you applied as a spouse or partner (27 months if you applied before 9 July 2012). The visa can then be extended for another 30 and then after 5 years you may be able to apply for settlement depending on the conditions of your particular visa.

There are certain criteria which you must fulfil to be successful in a Spouse, Partner and Family Member Visa application. SJS Solicitors have been accredited by the Law Society at both a Level 2 and a Supervisor Level for Immigration and Asylum cases and as such are very well placed to give your application the highest chance for success.

As a guideline, generally to be successful in application for Spouse, Partner and Family Member Visas you must:

  • The Applicant’s partner must be either a British citizenship or settled in the UK or in the UK with refugee leave or with humanitarian protection
  • You both must be over 18 or over
  • You both must be in a relationship that is genuine and recognised in the UK and must be subsisting at the time of the application
  • You both must not be within the prohibited degree of relationship
  • If married, the marriage or civil partnership must be valid
  • If the applicant is a fiancé(e) or in a proposed civil partner they must be seeking entry to the UK to enable the marriage or civil partnership
  • Any previous relationship must have broken down permanently
  • The parties intend to live together in the UK as husband and wife or in a civil partnership
  • There is an adequate place for both parties to live in the UK
  • The Applicant have a good knowledge of English
  • The Applicant do not have a criminal record in the UK or in another country

There are also financial requirements that must be met, in general these are that the applicant’s partner or spouse must prove that they are earning:

  • £18,600 per year if the application is for spouse only
  • £22,400 per year for spouse and one child
  • £2,400 per year for each additional child

The above are the standard requirements but there are other requirements which must be fulfilled such as suitability, family life criteria, life as a partner under Appendix FM, your relationship, English language requirement, financial requirement & compliance as well as compliance with Appendix FM-SE. Fees

Our Fees for a Spouse, Partner and Family Member Visa application are fixed at £1875 + VAT, this includes our consultancy fee of £125 + VAT, which includes a 45 minute meeting with our Principal Solicitor where we discuss the details of your case, and allow you to decide if you would like to proceed with instructing our firm, if you decide not to, only the consultancy fee is payable. Our fees do not include any Home Office fees or disbursements which have to be paid separately.

Our consultancy fee includes:

  • A 45 minute meeting with our Principal Solicitor
  • A client care letter detailing all advice given in the meeting sent within 24 hours
  • The option to choose if you want to instruct our firm or not for your matter
